The three were picked up on Thursday evening as detectives intensified investigations into the fatal shooting that shocked Nairobi earlier in the week.
Mbobu was ambushed on September 9 while driving home along Magadi Road in Karen.
Gunmen sprayed his vehicle with bullets before fleeing, leaving the prominent lawyer with eight wounds.
A post-mortem later confirmed he died from heavy bleeding after two bullets were recovered from his body.
Investigators revealed that Wainaina was among the last people to interact with Mbobu.
The two reportedly shared a meal at a city hotel only hours before the shooting.
Police are also tracking another meeting the lawyer held within the Central Business District before setting off for home.
Wainaina’s lawyer, Maulid Musa, confirmed his client’s arrest but said no formal charges had been presented.
“He was taken from his home in Karen and placed in custody. While we know investigations are ongoing, nothing has been shared to suggest that his arrest is tied directly to the murder,” Musa explained.
Wainaina was later moved from Kileleshwa Police Station to a hospital after he developed health complications.
The other two suspects are being held at Kilimani and Capital Hill police stations as detectives continue questioning them.
Police sources said CCTV recordings are also being analyzed.
The footage captured Mbobu’s final movements, including a suspicious man dressed in black who appeared to trail him when leaving his office.
Detectives are working to establish the identity of the man and his possible role in the attack.
On Friday, members of the Law Society of Kenya marched through Nairobi’s Central Business District demanding justice.
Led by LSK President Faith Odhiambo, the lawyers called for speedy investigations and protection of legal practitioners, warning that the killing had caused fear within the profession.
